The right to religious freedom has been approached with different intensity by the European Court of Human Rights and by the protective institutions of the Inter-American System, the Commission and the Court. However, the differences between the two protective spheres of human rights are not only quantitative, because they respond to different historical, political and social realities. Even so, there are also meeting points in the titular and obligated subjects, in the outline of their content and in their limits. The (...) most striking aspect of the European Court is the constant recourse to the margin of national appreciation in the face of the diversity of positions of the member states of the Council of Europe; and, in the Inter-American System, the linking of the right to protection of the most vulnerable, either through the worldview of indigenous peoples, or because of its relationship with the work of many civil society activists with the poorest. This article considers two arguments that purport to show that inductive reasoning is unjustified: the argument adduced by Sextus Empiricus and the (better known and more formidable) argument given by Hume in the Treatise. While Sextus’ argument can quite easily be rebutted, a close examination of the premises of Hume’s argument shows that they are seemingly cogent. Because the sceptical claim is very unintuitive, the sceptical argument constitutes a paradox. And since attributions of justification are theoretical, and the claim that (...) they are never (or seldom) true isn’t preposterous, the correct response to the paradox may well be to admit that the sceptic has exposed our error in making them. Se propone una reflexión filosófica sobre el imperativo ético y político de pensar y reconstruir nuestro pasado a partir de la experiencia del sujeto latinoamericano oprimido y resistente. En este orden de ideas, el objetivo principal del artículo es emprender una búsqueda de aquellos lugares en los que habitan y se conservan en el tiempo las memorias de los latino-americanos antes y después del proceso de colonización o de “invasión” de la Modernidad europea. Esta indagación se inclina específicamente hacia esas (...) memorias “no oficiales”, construidas desde las comunidades en sus prácticas culturales, que mediante la rememoración y la tradición oral crearon vínculos de resistencia contra el olvido, al tiempo que preservaban aspectos fundamentales de sus tradiciones. Así, llamamos lugares a aquellos elementos que albergan fragmentos de lo pretérito invisibilizado por el discurso histórico oficial y que permiten establecer un vínculo trascendente entre pasado y presente, una recreación del pasado que surge a partir de la reconstrucción interpretativa de ruinas, rastros y vestigios de un tiempo que no ha dejado de ser y al que aún es posible acceder y conocer. Her question is Kant's 'How is knowledge possible?', answered from a contemporary naturalist standpoint. We begin with an understanding of what the world is like prior to cognition, then develop a theory of cognition within that world.

The aim of this paper is to show that we are entitled to see in Schütz’s article “Equality and the Social Meaning Structure” the proposal for a formal analysis of group membership understood as a kind of We-experience irreducible to pure We-relationships. First I argue that such an account defines the experience of group membership as a “situation definition process”. Then I show the relevance of this approach for the description of membership experiences and current debates on Collective Intentionality. Finally, (...) If used as a shopping list, the world is supposed to conform to the representation: if the list does not match what is in the grocery bag, it is what is in the bag that is at fault. But if used as an inventory list, the (...) representation is supposed to conform to the world: if the list does not match what is in the bag, it is the list that is at fault. The first kind of representation, where the world is supposed to conform to the list, can be called "directive"; it represents or directs what is to be done. The second, where the list is supposed to conform to the world, can be called "descriptive"; it represents or describes what is the case. Entre las críticas de los más férreos oponentes de la teoría kuhniana de la ciencia sobresale un reparo que fue planteado simultáneamente tanto por Popper, como por su discípulo Watkins. Ambos filósofos sostuvieron que, si nos comprometemos con la tesis que afirma que hay Ciencia Normal, tendríamos que aceptar la consecuencia absurda de que las teorías científicas degeneran en dogmas. En este trabajo mostraré que la tesis de Kuhn no tiene las implicaciones desastrosas atrás señaladas y que Popper -y Watkins- (...) ofrecen una imagen increíblemente distorsionada de la naturaleza misma de la Ciencia Normal y de los paradigmas, a tal punto que las razones en las cuales Popper basa la acusación de dogmatismo dependen de un argumento defectuoso. Para ello, voy a contrastar los patrones históricos que Kuhn identifica en los episodios de Ciencia Normal, con las características que le atribuyen sus críticos. Argumentaré, a partir de las contribuciones de Hooke a la mecánica clásica, que no es cierto que uno de los atributos que distingue a los “científicos normales” sea la adhesión doctrinaria, i.e., que el científico normal está obligado a suscribir una teoría por moda o por autoridad. RESUMEN Se analiza si la versión de la justicia como equidad, presentada en El liberalismo político, es genuinamente una concepción política. Se examina el problema de la razonabilidad de las doctrinas comprehensivas, y se indaga luego si el argumento en dos etapas afecta la integridad estructural del liberalismo político. Se concluye que J. Rawls fracasa en su intento de justificar un liberalismo independiente de una doctrina comprehensiva de carácter liberal. ABSTRACT The article analyzes whether the conception of justice as fairness, (...) set forth by Rawls in Political Liberalism, is a genuine political conception. It first examines the issue of reasonableness of comprehensive doctrines and then goes on to inquire whether the two-step argument affects the structural integrity of political liberalism. This paper aims to analyze the metaphorological project of Hans Blumenberg in relation to the philosophical developments of conceptual history in the mid-twentieth century. It is argued that Blumenberg, based on the study of metaphor, seeks to endow philosophy with a historical substrate that gives rise to the concept, forgotten by the inheritance of the cartesian philosophy. In this way, metaphors, but also myths and anecdotes, fulfill a pragmatic guiding function of thought and expe- rience, becoming indispensable for human life.

This book explores the ways deconstruction addresses the issue of futurity (what Jacques Derrida calls the "to-come," [l'à-venir]). In order to achieve this, it focuses on three French expressions, venue, survenue, and voir-venir, each taken from the work of Jacques Derrida, Jean-Luc Nancy, and Catherine Malabou. The idea behind this focus is to elude the issue of the one and only "to-come," as if this was a uniform and coherent entity or structure of experience, and to put forward instead the (...) possibility of a multiplicity of structures, each with a different intonation or pitch. How the various things that are said to have meaning—purpose, natural signs, linguistic signs, perceptions, and thoughts—are related to one another.

I defend the historical definition of "function" originally given in my Language, Thought and Other Biological Categories (1984a). The definition was not offered in the spirit of conceptual analysis but is more akin to a theoretical definition of "function". A major theme is that nonhistorical analyses of "function" fail to deal adequately with items that are not capable of performing their functions.

In this article, we illuminate the affective phenomenon of loneliness by exploring the question of how it relates to love and other forms of friendship. We reflect in particular on the question of how different forms of loneliness are relevant to human existence. Distinguishing three forms of loneliness, we first introduce two border cases of loneliness: unfelt loneliness in which one’s individuality is denied and one therefore cannot feel lonely; and existential loneliness in which the possibility of intimacy and existential (...) communication are denied and one therefore cannot but feel lonely. We then turn to loneliness that occurs within intimate friendships—even the most intimate ones. In our analysis, we pay attention especially to the role of communication. In order to do so, we repeatedly turn to poetic expressions of loneliness. We argue that loneliness cannot reflect only the absence or partial failure of communication but also the inherent limits of communication. These limits in turn point back to the nature of human existence and love itself. (shrink)

Ruth Millikan is well known for having developed a strikingly original way for philosophers to seek understanding of mind and language, which she sees as biological phenomena. She now draws together a series of groundbreaking essays which set out her approach to language. Guiding the work of most linguists and philosophers of language today is the assumption that language is governed by prescriptive normative rules. Millikan offers a fundamentally different way of viewing the partial regularities that language displays, comparing (...) them to biological norms that emerge from natural selection. This yields novel and quite radical consequences for our understanding of the nature of public linguistic meaning, the process of language understanding, how children learn language, and the semantics/pragmatics distinction. Concepts are highly theoretical entities. One cannot study them empirically without committing oneself to substantial preliminary assumptions. Among the competing theories of concepts and categorization developed by psychologists in the last thirty years, the implicit theoretical assumption that what falls under a concept is determined by description () has never been seriously challenged. I present a nondescriptionist theory of our most basic concepts, which include (1) stuffs (gold, milk), (2) real kinds (cat, chair), and (3) individuals (Mama, Bill Clinton, the (...) Empire State Building). On the basis of something important that all three have in common, our earliest and most basic concepts of substances are identical in structure. The membership of the category like that of is a natural unit in nature, to which the concept does something like pointing, and continues to point despite large changes in the properties the thinker represents the unit as having. For example, large changes can occur in the way a child identifies cats and the things it is willing to call without affecting the extension of its word The difficulty is to cash in the metaphor of in this context. Having substance concepts need not depend on knowing words, but language interacts with substance concepts, completely transforming the conceptual repertoire. I will discuss how public language plays a crucial role in both the acquisition of substance concepts and their completed structure. (shrink)

Pregnancy presents some interesting challenges for the philosophy of embodied cognition. Mother and fetus are generally considered to be passive during pregnancy, both individually and in their relation. In this paper, we use the enactive operational concepts of autonomy, agency, individuation, and participation to examine the relation between mother and fetus in utero. Based on biological, physiological, and phenomenological research, we explore the emergence of agentive capacities in embryo and fetus, as well as how maternal agency changes as pregnancy advances. (...) We show that qualitatively different kinds of agency have their beginnings already in utero, and to what extent fetal and maternal movement modulate affectivity and individuation in pregnancy. We thus propose that mother and fetus are both agents who participate in pregnancy. Pregnancy then emerges as a relational developmental organization that anchors and holds its developing participants. We end the paper with reflections on ethical implications of this proposal, and suggestions for future research. (shrink)

In this article, I provide a philosophical analysis of the nature and role of perceived identity threats in the genesis and maintenance of fanaticism. First, I offer a preliminary definition of fanaticism as the social identity-defining devotion to a sacred value that demands universal recognition and is complemented by a hostile antagonism toward people who dissent from one’s group’s values. The fanatic’s hostility toward dissent thereby takes the threefold form of outgroup hostility, ingroup hostility, and self-hostility. Second, I provide a (...) detailed analysis of the fears of fanaticism, arguing that each of the three aforementioned forms of hostile antagonism corresponds to one form of fear or anxiety: the fanatic’s fear of the outgroup, renegade members of the ingroup, and problematic aspects of themselves. In each of these three forms of fear, the fanatic experiences both their sacred values and their individual and social identity as being threatened. Finally, I turn to a fourth form of fear or anxiety connected to fanaticism, namely the fanatic’s anxiety of and flight from the existential condition of uncertainty itself, which, at least in some cases, ground the fanatic’s fearfulness. Exploitation locates what it is we recognize as bad when we judge a situation to be exploitative. Ideal for courses in social and political philosophy, public policy, or political science.

By whatever general principles and mechanisms animal behavior is governed, human behavior control rides piggyback on top of the same or very similar mechanisms. We have reflexes. We can be conditioned. The movements that make up our smaller actions are mostly caught up in perception-action cycles following perceived Gibsonian affordances. Still, without doubt there are levels of behavior control that are peculiar to humans. Following Aristotle, tradition has it that what is added in humans is rationality ("rational soul"). Rationality, however, (...) can be and has been characterized in many different ways. I am going to speculate about two different kinds of cognitive capacities that we humans seem to have, each of which is at least akin to rationality as Aristotle described it. The first I believe we share with many other animals, the second perhaps with none. Since this session of the conference on rational animals has been designated a "brainstorming" session, I will take philosopher's license, presenting no more than the softest sort of intuitive evidence for these ideas. Corruption poisons corporations in America and around the world, and has devastating consequences for the entire social fabric. In this article, we focus on organizational corruption, described as the abuse of authority for personal benefit, and draw on Weber’s three ideal-types of legitimate authority to develop a theoretical model to better understand the antecedents of different types of organizational corruption. Specifically, we examine the types of business misconduct that organizational leaders are likely to engage in, contingent on their legitimate authority, (...) motives, and justifications.
